This morning, the Supreme Court is engaged in hearing oral arguments regarding the enforcement of former President Donald Trump’s birthright citizenship order. At the heart of the matter for the justices is determining whether lower courts exceeded their powers by universally blocking the order issued on January 20.

The Trump administration has portrayed its appeal as a modest attempt to curb the reach of these injunctions. However, critics argue that the president’s proposal could potentially allow the government to broadly implement the contentious birthright citizenship directive.

For over a hundred years, judicial interpretations of the 14th Amendment text have affirmed that “all persons born or naturalized in the United States” are entitled to U.S. citizenship, irrespective of their parents’ immigration status.
