White House Advisor Discusses Potential Suspension of Habeas Corpus to Tackle Immigration

Senior White House advisor Stephen Miller recently revealed that the Trump administration is “actively exploring” the option of suspending habeas corpus, which allows individuals to contest their detention by the government. This statement came in response to a journalist’s inquiry about President Donald Trump considering the suspension of the writ of habeas corpus as a strategy to address illegal immigration issues in the United States.

Historically, the suspension of this legal provision has occurred only four times since the establishment of the U.S. Constitution, with Congressional approval being required in three of those instances. “The Constitution clearly states,” Miller remarked at the White House, “as the supreme law of the land, that the privilege of the writ of habeas corpus can be suspended during times of invasion.”
